Democracy for Citizens Party deputy leader, Cleophas Malala, has spoken out about the political future of former Deputy President Rigathi Gachagua.

Despite the current impeachment proceedings against Gachagua, Malala says there is no law stopping him from running for any elective position—for now.

Speaking at a public forum, Malala pointed to Article 56, which protects the presumption of innocence.

He explained that Gachagua is still considered innocent until the legal process proves otherwise.

“Everyone has a right to be presumed innocent until proven guilty,” Malala said. “The impeachment case against Rigathi is ongoing.

Unless it is concluded and he is found guilty, and all chances to appeal are fully used up, there is no reason to disqualify him from seeking public office.”

Malala stressed that the legal process must be followed to the end.

He explained that only if the impeachment process is found to have been legal and results in a guilty verdict with no more appeals left—can Gachagua be barred from vying for office.

“As it stands right now, Rigathi Gachagua can run for any office. The law is clear,” he said.

Malala also reminded the public that the Bill of Rights still protects Gachagua’s freedoms, including his right to participate in politics.

“Until he is found guilty and has no further appeals left, he still enjoys his rights under the Constitution,” Malala added.
