The Court of Appeal has refused to suspend a High Court ruling that declared the Azimio party as the majority in the National Assembly, dealing a setback to Speaker Moses Wetangula’s bid to overturn the decision.

Wetangula had argued that the ruling disrupted legislative functions, but the Court dismissed his claim, stating that there was no sufficient evidence to prove parliamentary business had been paralyzed.

The judges noted that despite the Speaker’s contested ruling on February 12, 2025, the National Assembly had continued to function, though with some acrimony.

They further ruled that granting a stay order would amount to prematurely endorsing the Speaker’s decision before the High Court determined whether it complied with its earlier judgment.

 

Concerns that the ruling could lead to legal consequences, such as contempt of court proceedings against Speaker Wetangula, were also dismissed.

The Court stated that the possibility of being summoned for contempt and the associated inconvenience or embarrassment were not sufficient grounds to halt proceedings. With this decision, the question of which party holds the majority in the National Assembly remains unresolved, extending the legal battle.
