DCP leader and former Deputy President Rigathi Gachagua has returned to the Court of Appeal to challenge a High Court decision that upheld his impeachment.
According to a report received by the news desk, Gachagua is contesting the findings of a three-judge bench that his removal from office could not be overturned, even if his constitutional rights were violated during the impeachment process.
The former Deputy President is seeking to have the appellate court review the High Court’s decision and reconsider the circumstances surrounding his removal from office.
Gachagua’s impeachment followed his political fallout with President William Ruto. His supporters have previously argued that the process was politically motivated and linked to his disagreements with the President, while his critics have defended the constitutional process that led to his removal.
The latest appeal gives Gachagua another opportunity to challenge the legal basis of his impeachment as he continues his political activities under the Democracy for the Citizens Party.
The case is also attracting significant political attention because of Gachagua’s continued opposition to the Ruto administration and his growing involvement in preparations for the 2027 General Election.
Gachagua is hoping that the Court of Appeal will overturn the High Court’s position and grant him relief over the circumstances surrounding his removal.
If the appellate court eventually rules in his favour and finds that he is entitled to compensation or other remedies, the outcome could have significant legal and political implications.
The case is expected to remain closely watched as Gachagua continues to pursue both his legal challenge and his political ambitions.
