Popular Nairobi lawyer Nelson Havi has issued a fresh ultimatum to Chief Justice Martha Koome, demanding she appoint a bench of judges within 14 days.
The bench will be tasked with hearing a petition filed by Koome and six other Supreme Court judges against the Judicial Service Commission (JSC).
Havi, a fierce critic of the Chief Justice, warned that failure to act would prompt him to file a new petition accusing Koome of conflict of interest.
He declared he is ready to renew his battle against the embattled head of the Judiciary without hesitation.
Earlier this year, on January 13, Havi filed a petition with the JSC, seeking the removal of Koome and her six Supreme Court colleagues. He accused them of gross misconduct, alleging they entertained appeals of little public interest, hinting at possible corruption.
The JSC responded by acknowledging Havi’s petition and starting the process to investigate the claims.
In a swift move, CJ Koome and the six judges sued the JSC, seeking to block the body from hearing the removal petitions.
Koome argued that allowing the JSC to proceed would be a mockery of justice. She successfully secured conservatory court orders stopping the Commission from handling the petitions against her and the other judges.
Following the court orders, Havi temporarily suspended his campaign to unseat the seven judges. However, he has now rekindled the fight, insisting that Koome must set up a proper bench to hear the case without delay.
Havi maintains that if CJ Koome fails to comply, he will not only file a fresh petition but will also ensure she faces new accusations at the JSC.
His latest move signals a fierce legal showdown in the coming days.
Despite the mounting pressure, CJ Koome has continued to put on a brave face, vowing to defend herself and the integrity of the Judiciary.
The coming two weeks will be crucial as the nation watches how this high-stakes battle unfolds.
