LIn a powerful statement, outspoken lawyer and political commentator Dr. Miguna Miguna has reignited debate over the recent political reshuffle involving Deputy President Rigathi Gachagua.
Dr. Miguna stated, “I told the merchants of impunity and their zombies that the removal of Rigathi Gachagua as DP was illegal and that it would be nullified on appeal. Where are they hiding now?”
His remarks follow a landmark appellate court ruling that found the removal of Gachagua from office unconstitutional. The ruling cited a lack of due process, including the absence of parliamentary approval and failure to adhere to Article 150 of the Kenyan Constitution, which outlines the procedures for removing a sitting Deputy President.
The court emphasized that no tribunal had been formed, nor had the National Assembly deliberated or voted on any motion of removal, making the entire process procedurally flawed.
Miguna did not mince his words as he called for the resignation of the newly installed deputy, popularly nicknamed “Mtoto Misa,” declaring that, “His appointment was illegal from the start, and now that the court has spoken, he must vacate office immediately.”
Legal experts have echoed Miguna’s sentiments, warning that failure to comply with the ruling may trigger a constitutional crisis and set a dangerous precedent of impunity.
This development has placed the Executive under intense scrutiny, as political analysts and citizens alike demand accountability and respect for the rule of law.
