A Milimani Court has released Mukurwe-ini Member of Parliament John Philip Gichohi Kaguchia on bond. The court set the bond at Ksh1 million with an alternative cash bail of Ksh250000.
Senior Principal Magistrate Theresa Nyangena freed the MP on Tuesday. Kaguchia was set to be charged with offensive conduct conducive to breaches of the peace.
The charge falls under section 94(1) of the Penal Code. It relates to remarks the MP made that authorities considered inciteful.
However his defence team objected to him taking a plea on the charges. They argued that the Directorate of Public Prosecutions had not framed the charges properly.
Following the objection the court postponed hearing of the application. The matter will now be heard on Wednesday August 5 2026.
Kaguchia has been at the centre of political tension in recent days. He had earlier raised alarm claiming armed men surrounded Royal Media Services studios where he was staying.
The MP is an ally of former Deputy President Rigathi Gachagua and Democracy for Citizens Party. He was arrested by detectives following remarks made at a political gathering in Nyeri County.
Authorities linked his arrest to comments he made cautioning Mount Kenya residents against supporting President William Ruto in 2027. Critics interpreted the remarks as threatening while Kaguchia maintained they were misrepresented.
He was first taken to DCI headquarters before being moved to Kamukunji Police Station. DCP leaders had earlier complained of delays in his release despite a court order granting him bail.
The case has continued to draw attention amid rising political temperatures ahead of the 2027 general election. Kaguchia’s allies have described his arrest as a political witch-hunt targeting opposition voices.
For now the MP remains free on the cash bail terms issued by the court. His legal team is expected back in court on Wednesday to argue against the plea-taking process.
