The Independent Electoral and Boundaries Commission (IEBC) has stated that it cannot process or recognize the withdrawal of any candidate from the forthcoming by-elections once the legally prescribed deadline has passed.
In a statement issued on Thursday, the commission explained that the Elections Act clearly outlines the timelines within which a candidate may formally withdraw from an electoral contest.
Once that window closes, IEBC said, the names of all duly nominated candidates must remain on the ballot.
“The law provides a specific period for withdrawal after nomination. Any request made after this period cannot be legally effected,” the statement read in part.
“The Commission is therefore bound to proceed with the elections as planned, including all candidates whose names were published in the gazette.”
The clarification comes amid reports that some aspirants in upcoming by-elections had attempted to step down in favour of rivals or after political negotiations.
IEBC noted that while political alignments are normal in a democratic setting, it must uphold the law and maintain electoral integrity.
The commission further urged political parties and candidates to familiarize themselves with electoral timelines to avoid confusion and last-minute disputes.
By-elections are scheduled in several constituencies and wards across the country following vacancies occasioned by deaths, resignations, or nullification of results.
