Ann Mwathi, the mother of the late interior designer Jeff Mwathi, has reacted to the recent developments of a new evidence that was presented in court, that exonerated mugithi musician DJ Fatxo from the claims that he had allegedly sexually assaulting her son before he died in February 2023.

This evidence was actually submitted at the Milimani Law Courts on Tuesday by retired government pathologist Peter Ndegwa, who was the first pathologist to handle Jeff’s body when he died.

The pathologist revealed that there was no evidence of sexual assault after being cross-examined by lawyer Duncan Okatch, who was representing DJ Fatxo.

Duncan Okatch asked Peter Ndegwa “Did you find any evidence of sexual assault?”

“No” Peter Ndegwa responded.

 

According to reports, Peter Ndegwa’s evidence was also corroborated by the evidence that the chief government pathologist Johansen Oduor also gave, where he revealed that he also did not find anything that would suggest that the late interior designer was sexually assaulted before he died.

Ann Mwathi however feels like this is not entirely true because Johansen Oduor had conducted another autopsy in March 2023, just a month after Jeff Mwathi died, and it revealed that Jeff Mwathi had fractures on his neck and limbs that he got before he died.

 

Ann Mwathi has further questioned how the cause of Jeff Mwathi’s death has never been conclusively established since he died, and she feels like it is because the investigators did not do their job as well as they should in handling the samples that they took for investigations.

“He (Johansen Oduor) told the court that in this case the police were to investigate the crime scene and tell the cause of his death.

Oduor said his work was to collect samples to take to government chemist for analysis but he was not the one to conduct the analysis. He further told the court that upto date he has never seen the results of the samples he took from Jeff’s body.

It was the duty of the investigating officer to go collect the samples from the government chemist then take the report to him for confirmation…” she said in part.

Ann Mwathi added:

“According to him, the timeline between death and the time of autopsy could hinder a lot of findings due to decomposition and the changes in the body. In Jeff’s case, he couldn’t look at him and say he was sodomized or not. Its on record, Oduor told the court the bruises on Jeff’s body were cause before death”.
