Former Nairobi Provincial Commissioner Davis Chelogoi has been convicted in a Sh1.35 billion land fraud case involving businessman Ashok Shah, in a major development in a long-running dispute over a prime piece of land in Nairobi.

The case has attracted attention because of the value of the property and the legal battles that have surrounded its ownership.

According to reports, the disputed property is a 7.39-hectare parcel of land in the Lower Kabete area of Nairobi. The prosecution accused Chelogoi and former Lands Administration official Andrew Aseri Kirungu of conspiring to have the property registered in Chelogoi’s name.

The dispute also involves businessman Hitenkumar Amritlal Raja, who, alongside Shah, has pursued claims over the property.

The land has been at the centre of several court proceedings, including a previous Environment and Land Court decision that declared Shah and Raja the lawful owners in July 2022.

Chelogoi, however, has maintained that he legally acquired the land through a government allocation in 1995. He has challenged the criminal proceedings and argued that his claim to the property is legitimate.

The latest development comes after years of legal arguments and applications seeking to stop or delay the criminal case.

The case has also drawn attention to the wider issue of land ownership disputes in Kenya, where valuable properties can become the subject of lengthy court battles involving competing ownership documents.

However, the precise outcome of the latest proceedings, including the reported cancellation of Chelogoi’s bond and his remand ahead of sentencing, should be confirmed through an up-to-date court report.

The Standard reported on October 9, 2026, that the High Court had suspended the criminal proceedings pending a ruling on Chelogoi’s application. This makes it important to verify any subsequent conviction before presenting it as confirmed news.

The case remains significant because of the value of the disputed property and the legal questions surrounding its ownership.

Kenyans will be watching for further developments as the courts determine the next steps in the matter.
