National Assembly Speaker Moses Wetang’ula has officially declared the parliamentary seat of nominated MP Denar Joseph Hamisi vacant following his passing on Saturday, December 6, 2025, at the age of 56.

 

In a gazette notice dated January 2, 2026, Wetang’ula cited Articles 101 (2) (a) and 103 (1) (a) of the Constitution, alongside Section 16 (3) of the Elections Act, to formalize the vacancy. The notice reads that Hamisi’s seat, which he held under Article 97 (1) (c) of the Constitution, became officially vacant with effect from December 6, 2025.

 

Under Kenyan law, a parliamentary seat falls vacant upon the demise, resignation, or expulsion of a member, and the speaker must issue a vacancy notice within 21 days. For nominated MPs like Hamisi, the replacement process is managed by the political party they represented, in this case, the Amani National Congress (ANC), using the party list submitted to the IEBC before the 2022 General Election. No by-election is conducted for nominated seats.

This procedure ensures continuity in representation while maintaining constitutional compliance.
