A Nairobi court has given a 28-year-old man a second chance after he stole train parts to support his family, sentencing him to a one-year suspended term. Josphat Kamau Chege was charged with theft, contrary to Section 268(1) read with Section 275 of the Penal Code, after being caught stealing three metal radiator grills from the Kenya Railways Corporation valued at Ksh40,566.

The incident occurred on January 4, 2026, around 3:00 PM at the Kenya Railways workshop in Nairobi. Railway security officers on routine patrol noticed Kamau carrying metals wrapped in bedsheets. When they attempted to apprehend him, he tried to flee but was caught. The stolen grills were presented in court as exhibits, and Kamau confirmed that they were the items he had taken.

During his appearance before Milimani Chief Magistrate Dolphina Alego on January 6, Kamau admitted to the theft but said he did not know the metals were of use to Kenya Railways. He appealed to the court for mercy, explaining that he has a wife and two children who depend on him and that his family had been unaware of his whereabouts since his arrest. Kamau also said he works carrying watermelons while his wife does laundry in Muthurwa to support the family.

Magistrate Alego considered Kamau’s plea and personal circumstances but warned him against future criminal activity. He was sentenced to a 12-month suspended term, meaning he will avoid jail as long as he does not commit another offense within the period. Kamau has 14 days to appeal the decision.

The case highlights the struggles some individuals face in providing for their families and the court’s discretion in balancing justice with compassion.
