The impeachment case involving former Deputy President Rigathi Gachagua, has continued to attract public attention, with details emerging on the findings that informed the decision to remove him from office.

According to Justice Eric Ogolla, on Monday, June 8, 2026, Gachagua was found to have engaged in conduct that violated the constitutional standards expected of a holder of the country’s second-highest office. The judge noted that the former deputy president repeatedly made statements that misled the public and fueled division among Kenyans.

Justice Ogolla stated that Gachagua’s public remarks were not only false but also carried elements of incitement, creating unnecessary tension within the country. The court observed that leaders occupying senior public offices are expected to promote national unity and cohesion rather than advance narratives that could deepen political or social divisions.

The judge further faulted Gachagua for allegedly undermining the work of the National Intelligence Service (NIS). According to the findings presented before the court, his actions and statements cast doubt on the operations of key state institutions, a move that was viewed as detrimental to public confidence in government agencies tasked with safeguarding national security.

Another issue highlighted by the court was what Justice Ogolla described as persistent insubordination towards President William Ruto. The ruling indicated that Gachagua repeatedly acted in a manner inconsistent with the constitutional relationship expected between the President and Deputy President.

In addition, the judge accused the former deputy president of continuously intimidating and bullying public officers. Such conduct, the court noted, was incompatible with the values of leadership, integrity, accountability, and respect for public institutions.

 

The ruling has added a significant chapter to Kenya’s political landscape, with its implications expected to shape discussions on leadership, accountability, and constitutional governance in the years ahead.
