The Milimani Law Courts has closed a burial dispute involving the family of KCB Head of Data Protection Rosemary Cherono Kimwatu after her husband withdrew the suits he had filed over her burial.
Kelvin Migwe Kimwatu withdrew the cases after confirming Cherono had been buried at night, according to details presented before the court.
The husband had challenged the burial arrangements and sought to be involved in decisions concerning the final rites.
Following confirmation that the burial had already taken place, he declined to seek the exhumation of Koech’s remains or pursue contempt proceedings against her relatives or KCB.
Kimwatu told the court that he would leave what had happened to God and chose not to pursue further legal action over the burial.
The dispute was subsequently brought to an end after Rosemary’s parents agreed that her husband and their four children would have access to her graveside at any time.
The agreement paved the way for the closure of the matter at the Milimani Law Courts.
The case had attracted attention after the court was moved to intervene in the burial arrangements following a dispute between Kimwatu and his late wife’s family.
