High Court judge Lawrence Mugambi has dismissed a case filed by Eldoret-based singer William Getumbe, known for his controversial song ‘Yesu Ninyandue’.
Getumbe had moved to court seeking over Ksh.243,000 in compensation from the Kenya Film Classification Board (KFCB) for banning his song.
KFCB banned the song in February last year, citing its blasphemous nature and potential to offend religious sensitivities.
The authority also instructed the singer to remove the song and any other inappropriate content from his online platforms, warning that failure to comply would result in legal repercussions, as outlined by the Films and Stage Plays Act Cap 222.
Getumbe’s song was banned alongside a similar one by Kisii-based singer Chris Embarambamba titled “Niko Uchi”. The song sparked controversy for its purported gospel theme, which the KFCB argued invites ridicule to the Christian religion.
