The Federation of Kenya Employers has today issued a strategic directive to all employers across the country.
Addressing vvia a statement dated 12th June 2026, the Federation of Kenya Employers has directed all employers in Kenya to impose the National Social Security Fund (NSSF) deductions on employees monthly salaries as per the institutionalized Act governing the deductions.
The national body has articulated that all employers are required to impose the NSSF monthly deductions on the salaries of their respective employees as per the new rates envisaged on the established NSSF Act of 2013.
The national body’s directive comes just two weeks after the Court of Appeal quashed National Social Security Fund (NSSF) plea that solemnly sought to suspend a recent High Court ruling that had declared the NSSF Act of 2013 unconstitutional.
According to the landmark ruling delivered by the Court of Appeal, National Social Security Fund (NSSF) had failed to prove that if the stay is not granted, the situation will become entirely irreversible, causing severe damage to the pension sector.
The Court divulged that the appellant needed to provide concrete evidence the execution of the judgment would cause irreversible financial liquidation or render recovered assets inaccessible.
