The death of Simon Gichuru Warui while in police custody at Mombasa Central Police Station has sparked outrage, with activists linking his case to the earlier controversial death of Albert Ojwang.
Warui, a young father of one, reportedly left his Nairobi home on September 14 and was later traced to Mombasa by relatives. Police alleged that he had stolen KSh170,000 from his employer in Nairobi before fleeing to Mombasa, where he was arrested after seeking refuge in a church.
According to the police report, Warui died after falling while attempting to escape. Officers claimed he asked to use the washroom, scaled a wall, and fell to his death.
However, an autopsy revealed injuries that have raised serious questions. The report showed neck fractures, spinal injuries, scalp wounds, and ligature marks. Doctors said he died from cardiorespiratory collapse caused by a fracture-dislocation of the neck, consistent with a fall from a height.
His widow, Mary Njeri, and activists have dismissed the official account, accusing police of foul play and demanding transparency. Civil society groups have called for the release of CCTV footage from the station, but police have declined, saying investigations are ongoing.
The Independent Policing Oversight Authority (IPOA) has confirmed it has launched investigations and sent a team to Mombasa. Activists argue that the lack of openness and delays mirror the case of Albert Ojwang, who also died in police custody under questionable circumstances.
