Manyatta Member of Parliament Gitonga Mukunji has taken legal action against top government officials following his recent arrest during the Saba Saba protests.

In a petition filed at the High Court in Milimani, Mukunji is challenging what he calls a misuse of power by state agencies.

The petition names Inspector General of Police Douglas Kanja, Director of Criminal Investigations (DCI) Mohamed Ibrahim Amin, and Director of Public Prosecutions (DPP) Renson Ingonga as respondents.

Mukunji claims that his arrest, along with that of journalist James Ikuwa Mbochi and boda boda rider Stanley Mbuthia Wanjiru, was politically driven.

According to court documents, the trio argues that their arrest was not based on any credible evidence but was instead part of a broader plan to silence voices that speak out against the government.

They accuse state officers of misusing the Prevention of Terrorism Act to intimidate and punish critics.

Mukunji describes the incident as an abuse of legal process, claiming they were unfairly targeted simply for taking part in the Gen-Z-led protests.

The petition warns that such actions show a growing pattern where the anti-terror law is being applied in the wrong way—to suppress political opposition and scare off ordinary citizens from expressing their views.

“This is a dangerous trend,” the petition reads. “Using terrorism laws to silence dissent threatens the rights of Kenyans and the future of democracy in this country.”

The petitioners are asking the court to dismiss the terrorism-related charges against them and to declare their arrest illegal and unconstitutional.

They also want the court to stop security agencies from using the law to unfairly detain protestors or critics of the government.
