The National Cohesion and Integration Commission (NCIC) has turned up the heat on former Deputy President Rigathi Gachagua, recommending his prosecution for alleged hate speech after he failed to honour a formal summons.

Speaking on Monday, NCIC Chairperson Rev. Dr. Samuel Kobia disclosed that Gachagua’s failure to appear before the commission had raised serious concerns, especially as the country navigates a tense political climate. According to Kobia, the commission had summoned the former second-in-command to explain remarks deemed divisive and inflammatory but was met with silence.

“We followed due process. A summons was issued, and there was no response. The matter has now been handed over to the Director of Public Prosecutions for further action,” said Kobia during a press briefing.

The NCIC’s move is part of a wider investigation involving 26 public figures accused of inciting remarks or actions that could jeopardize national unity. Kobia emphasized that the law applies to all Kenyans regardless of their political stature.

Gachagua, known for his combative political tone, has in recent months been vocal in criticizing both the current administration and its economic policies. His speeches have often drawn sharp reactions from leaders and members of the public, prompting concerns over potential breaches of Kenya’s hate speech laws.

Kobia said the Commission remains committed to ensuring peace and cohesion, especially ahead of upcoming political protests and public gatherings.

Kenyans have taken to social media with mixed reactions, some defending Gachagua’s right to free speech while others have called for stricter enforcement of the law against divisive rhetoric.

The NCIC’s firm stance signals that inflammatory political language will no longer go unchecked.
