A petition has been filed by two activists challenging a law that stops retied presidents from participating in active politics or holding leadership positions in political parties.

Peter Agoro and Domon onyango want section 6 of the presidential retirement benefits quashed arguing that it’s discriminatory. According to the two activists, the law limits one to make a political choice.

They further argue that a retired president is a citizen and therefore free to make political choices which include the right to form a political party and campaign for a Political party.

The move comes after a rival faction of the jubilee party led by east Africa legislative assembly representative Kanini Kega ousted former president Uhuru Muigai Kenyatta as party leader and escalating the wrangles in the former ruling party.

The faction said nominated member of Parliament honourable Sabina Chege is the new party leader in an acting capacity following a national executive council (NEC) held

“Uhuru Kenyatta is no longer our party leader,” Kega said after the meeting in Nairobi, “we have replaced him with Sabina Chege.” said Kanini Kega.

In making their decision, they cited the retirement act which says a former president should resign from active politics six months after handing over power to his successor.

Should the two activists succeed in their move, it will be a huge relief to the retired president Uhuru Kenyatta who has been struggling to reclaim his party from the jaws of president William Ruto-allied legislators.

However, it will be a blow to Kanini Kega faction as they could be kicked out of the party and loss Their positions.
