The Supreme Court has filed a preliminary objection in the case filed by the Law Society of Kenya (LSK) challenging the apex court’s decision to bar lawyer Ahmednasir Abdullahi from appearing before it.

In the papers filed in court, the apex court in the land says that the petition filed by the lawyers’ body is defective as it seeks to challenge the recusal of its orders issued on 23rd January 2024.

“The decision of the Supreme Court is binding on all other courts except the Supreme Court,” reads court papers.

They say that the High Court is prohibited from exercising jurisdiction over matters reserved for the exclusive jurisdiction of the Supreme Court.

“The recusal order having been made in proceedings where the supreme court was exercising its exclusive jurisdiction…” reads the application.

In wanting to have the case dismissed and struck out the Supreme Court and the registrar of judiciary say the petition is in bad law and an abuse of court process.
