The Judiciary has issued a statement addressing misinformation regarding the Supreme Court’s handling of Reference No. E004 of 2024, an advisory opinion sought by the Independent Electoral and Boundaries Commission (IEBC).

The clarification follows a Citizen TV news report aired on February 1, 2025, and a corresponding digital article by the same media outlet suggesting that the Supreme Court would deliver a ruling today on whether new constituencies will be created before the 2027 elections.

According to Judiciary Spokesperson Hon. Paul Ndemo, the case is still at the submissions stage and counsel for all parties are focused on that. The IEBC has been granted three days, from February 3, to file its submissions, while the Attorney General will have two days to respond. Only after this will the matter be placed before the Chief Justice, Martha Karambu Koome for empanelment and scheduling of a hearing.

 

The Supreme Court urged media houses to exercise caution and ensure accuracy in reporting to prevent misleading the public. Citizen TV has been urged to issue a clarification to correct the narrative. Popular journalist Stephen Letoo is the one that did the story.
