The tribunal appointed to consider a petition for removal of the Independent Electoral and Boundaries Commission (IEBC) commissioner Irene Masit delivered its verdict on Monday, February 27.

In a final report, the tribunal’s Chairperson Justice Aggrey Muchelule recommended that Masit be removed from office.

“This Tribunal recommends to the President pursuant to the mandate assigned vide Gazette Notice No. 14890 of 2nd December 2022, and further in accordance and in compliance with Article 251(1) and (6),

In her final submissions to the court, embattled Masit had made a final attempt to convince the tribunal that she was innocent.

Through lawyer Donald Kipkorir, Masit said there was no evidence produced to show her culpability and gross misconduct in last year’s presidential polls. Kipkorir said the petition before the tribunal was not based on any law.

“The entire process is a legal charade from inception to date and shows a disdain of the Constitution, Standing Orders, and established law,” lawyer Kipkorir said.

The lawyer argues that original petitions filed against commissioners Masit, Juliana Cherera, Justus Nyang’aya, and Francis Wanderi lacked supporting evidence and as such contravene sections 107, 108, of The Evidence Act, and Article 50(2) (b) of the Constitution.
