Political analyst Arnold Maliba contends that the decision made by the ODM Party to expel five members considered disloyal is invalid.
He argues that the disciplinary action, which was approved by the party’s National Executive Committee (NEC) and chaired by Raila Odinga, cannot be upheld because Odinga is also a member of the Azimio La Umoja One Kenya Coalition Party.
Maliba’s position is based on political party regulations, suggesting that Odinga cannot simultaneously be a member of both the ODM and Azimio parties.
“The ruling and even the statement made by John Mbadi is null and void because a foreigner chaired the disciplinary committee. Raila is a foreigner in ODM. Raila is not a member of ODM. Raila and Martha Karua are members of Azimio and they have publicly presented themselves as the people who ran on Azimio which is actually a party,” said Maliba in an interview with NTV.
The political analyst suggests that the affected legislators should not be overly concerned about the party’s decision and should find solace in their situation.
“Raila ran on Azimio. He is still asking for servers to be opened saying Azimio won. So, in what capacity did he sit. This is a foreigner sitting in an ODM meeting to discipline ODM members.” He added.
The ODM party’s National Executive Committee (NEC) has officially announced the expulsion of five members, namely Elisha Odhiambo (Gem), Gideon Ochanda (Bondo), Felix Odiwuor ‘Jalang’o’ (Lang’ata), Caroli Omondi (Suba South), and Kisumu Senator Tom Ojienda.
These members were accused of violating the party’s Constitution and the Political Parties Act 2011 by openly supporting and associating with a rival political group, as well as opposing lawful decisions made by the party’s organs.
This decision was made after the NEC held a meeting chaired by party leader Raila Odinga and National Chairman John Mbadi. The decision followed the consideration of a report by the disciplinary committee, which had been investigating the conduct of these members.
