The Former president of Law society of Kenya Nelson Havi has firmly defended the judiciary , the law and it’s tenets from vile attacks, originating from Kenyans and rivals to the Hon Rigathi Gachagua, in what He specifically claims is gross negligence and inability to affirm oneself with the laws of the land.

In a personal deep thought and reasoning, Havi wondered why a section of people were very quick to insult the Judges, who are working tirelessly to arrive to a conviction concerning the disturbing issues that has combated the country, to a point of near comatose, in very many ways and forms.

His legal opinion swung into action after He claimed that no head of state or His deputy can assume responsibility in either of the offices without the swearing in by the centre for rights and justice (CRJ) , while being presided over by the Chief Justice , in this case Her lordship Martha Koome.

The legal mind dragged a case from 2017 , where former Chief Justice David Maraga voiced out His displeasure on the way the executive was handling and meddling on the matters of the judiciary, to points of openly advising them to go ahead and call for a referendum from Kenyans and terminate the judiciary wing from the arms of government, if they, at all, do not see it’s importance in any way.

This claims by Havi are timely following the ongoing cold war between the two sides, where Politicians attached to the rulling coalition have been training their guns towards judges , whom they claimed may be working under the behest of external forces, who allegedly influence the rulling of major cases that directly affect the government of the day.

Similar pattens were witnessed around 2017, during the general elections, where Maraga was at loggerheads with the top state officials after nullifying the elections, and calling for a fresh one, after suspected electoral fraud that took place at the time.

The status quo in government, which many legal intellectuals refer to as a Constitutional crisis, where Gachagua and Kindiki strive at the doorstep of the Deputy president’s Office, to occupy the seat, remains another true test of patience, fidelity to the constitution and trustworthiness of the legal Justice system.
