There was a light moment at the High Court of Kenya on Tuesday morning during the delivery of the Finance Act 2023 judgement after Lady Justice Christine Meoli made fun of one of Ruto’s prudent taxes in the Finance Bill Act of 2023.
This was after the judge smiled broadly while reading her judgment, saying she was smiling because the proposition of a 5% tax on wigs, false beards, and eyebrows did not make it to the Finance Act 2023.
There was a moment of laughter in the courtroom as the judge made fun of the failed tax measure which was set to have a great impact on beauty lovers.
“In respect of the finance bill, you can see I am smiling… hahaha…because the bill did not see the light of the day and was not enacted into the finance act and is, therefore, a non-issue,” she stated amid laughter from the courtroom.
She, however, said they were satisfied that the public participation process conducted by the National Assembly was sufficient.
“In view of the foregoing, we are satisfied that, applying the peel and substance test, the Finance Bill 2023 is a money bill; however, it contains matters that are extraneous to a money bill and are unconstitutional” partly said Justice Lawrence Mugambi in his ruling
Busia Senator Okiya Omtatah had appealed the act to court, challenging its implementation.
