A five-judge bench is this morning expected to hear applications touching on an advisory by former chief Justice David Maraga advising the President to dissolve Parliament.
Chief Justice Martha Koome reconstituted the five-judge bench to determine the case on a priority basis since it has been pending in court since 2019.
Justice Jairus Ngaah will preside over the bench that also has judges Lawrence Mugambi, Patricia Nyaundi, Moses Otieno and Tabitha Wanyama.
Maraga in 2020 advised President Uhuru Kenyatta to dissolve Parliament citing the failure of the Legislature to enact a law giving effect to the two-thirds gender rule principle.
But the advisory was subsequently challenged by 10 petitions which have since been consolidated.
In the case, various parties, including the National Assembly and Senate, have sued the former Chief Justice David Maraga following his advisory to retired President Uhuru Kenyatta to send all MPs packing for failing to pass laws to implement the two-thirds gender rule.
