An impeachment motion against Kenya’s Deputy President Rigathi Gachagua has officially been lodged, citing gross violations of the Constitution, criminal conduct, and gross misconduct. The motion, filed under Articles 145 and 150(1)(b) and (2) of the Kenyan Constitution, marks the beginning of a process that could lead to Gachagua’s removal from office.

Among the key accusations against Gachagua are violations of national values under Article 10 of the Constitution. The Deputy President is alleged to have made inciteful and inflammatory statements, risking ethnic tension and division. The motion also claims that Gachagua unlawfully acquired assets worth over Sh5.7 billion, including prominent properties like Tree Tops Hotel, Outspan Hotel, Olive Gardens Hotel, and Vipingo Beach Resort, through his sons and close relatives. The acquisition of these assets allegedly contradicts his declared monthly salary of Sh1 million.

The charges also include breaches of various laws such as the National Cohesion and Integration Act, the Anti-Corruption and Economic Crimes Act, and the Proceeds of Crime and Anti-Money Laundering Act. Additionally, Gachagua faces accusations of undermining key state officials, including Lady Justice Esther Maina and National Intelligence Service Director General Noordin Haji.

For the motion to proceed, at least one-third of the members of the National Assembly must support it, after which it will require two-thirds majority approval to advance to the Senate. If the Senate also supports the motion by a two-thirds vote after hearing the charges, Deputy President Rigathi Gachagua could be required to vacate his office.

The impeachment process is now in motion as the Clerk of the National Assembly reviews the admissibility of the charges.
