Nairobi lawyer Harry Karanja now wants DJ Evolve to apologize to Kenyans after his shooting case against Embakasi East MP Babu Owino flopped.
Milimani Senior Principal Magistrate Benard Ochoi on Tuesday acquitted Babu ruling the prosecution did not prove beyond any reasonable doubt that he was responsible for the shooting of the entertainer at a Nairobi popular club.
During the trial, DJ Evolve, whose real name is Felix Orinda, told the court he never witnessed the MP carrying a firearm inside the club, adding he did not see who shot him on the neck.
Karanja, a Member of Small Claims Court Bar-Bench Committee at Law Society of Kenya Nairobi Branch, said DJ Evolve should apologize to Kenyans who persistently called for his justice since his shooting incident in 2020.
The founder of Harry Karanja and Company advocates opined that Babu could not have escaped jail term if DJ Evolve did not exonerate him in his testimony.
“Since the shooting, there has been a sustained and consistent call for justice by Kenyans far and wide on behalf of DJ Evolve. What he might not understand is that this case wasn’t just about him, it was about whether the weak can access justice when aggrieved by the strong. By his spectacular capitulation, DJ Evolve has rubbished the mirage of access to justice for millions of Kenyans. He owes them an apology,” Karanja tweeted on Thursday.
The lawyer said the investigation officer and the prosecutor who handled the case should resign saying they bungled the proceedings due to incompetence.
“As public servants, they have wasted resources and undermined confidence in our judicial system by carrying out this charade. I have no evidence that they were compromised, but I have evidence that they are incompetent and wholly unsuited for the positions they occupy,” Karanja said.
