Housing levy battle continues to stir the nation after the High Court made its pronouncement that it is unconstitutional and unfair to Kenyans. President William Ruto and his Deputy President Rigathi Gachagua have promised to give the housing levy the necessary legal backing after the High Court decision.
Law Society of Kenya led by President Eric Theuri faulted the double standards of the court. Eric Theuri accused the courts of helping the government to get away with illegalities. He stated that the High Court cannot declare the housing levy unconstitutional and at the same time allow the government to collect the funds until January 10, 2024.
LSK president Eric Theuri further noted that when VAT was increased to 16% it was immediately implemented and also when the court okayed the housing levy the collection was backdated. However, now the Court has found the levy unconstitutional but allows the government to continue collecting. LSK president Eric Theuri said that when a court declares something to be unconstitutional and gives government more time appears to be an attempt by the judiciary to give the Executive time to put its house in order.
