Ndegwa Njiru, the lawyer for ousted Deputy President Rigathi Gachagua, has asserted that Kithure Kindiki’s swearing-in as Deputy President is unlikely to happen soon. He cited a conservatory order from the Kerugoya High Court, stating that the order is still in effect. Njiru challenged lawyer Tom Ojienda to proceed with the swearing-in despite the court’s directive, emphasizing the legal implications of the current situation.

The High Court recently issued a stay on Gachagua’s replacement, citing significant constitutional issues that require examination by a three-judge bench. This ruling has led to conservatory orders that prevent Kindiki from being appointed or assuming office. These legal challenges arose following Gachagua’s impeachment, which has raised critical questions about the process.

Ojienda has argued that the conservatory orders issued by a single judge are problematic and requested an expedited hearing to resolve the matter. He expressed a desire to adhere to the law and not circumvent judicial processes. The uncertainty surrounding Kindiki’s appointment continues as the legal battles unfold.

Despite the National Assembly’s approval of Kindiki’s nomination, these ongoing legal hurdles suggest that the transition of power will face significant delays, further complicating the political landscape.
