The High Court has outlined the next steps Chief Justice Martha Koome must take regarding the ongoing impeachment process against Deputy President Rigathi Gachagua. The court’s ruling, delivered on Friday, emphasized the constitutional responsibility of the judiciary in overseeing the impeachment process and providing clarity on the legal path forward.
Justice Daniel Musinga, who delivered the ruling, stated that CJ Koome must now form a special tribunal to examine the allegations leveled against DP Gachagua. The tribunal, comprising legal experts and independent adjudicators, will be tasked with investigating claims of gross misconduct and abuse of office made by several members of Parliament.
The court further instructed Parliament to submit all relevant evidence and documentation within seven days to the Chief Justice’s office, to expedite the formation of the tribunal. The impeachment motion, which has gained significant political traction in recent weeks, has sparked intense debate within government and opposition circles.
Responding to the court’s decision, a spokesperson for DP Gachagua stated that the Deputy President is confident that the tribunal will vindicate him of all allegations. Meanwhile, political analysts suggest that the process could lead to heightened tensions between President William Ruto’s administration and rival factions in Parliament.
Chief Justice Koome is expected to act swiftly in constituting the tribunal, with the impeachment hearing likely to take place within the coming months. The country is now closely watching as the process unfolds, potentially setting a historic precedent.
