On Wednesday, the High Court issued directives in response to a petition contesting the impeachment of Deputy President Rigathi Gachagua. The petition was filed by city lawyer Steven Mbugua in collaboration with the Gema Watho Association, challenging the Senate’s decision to remove Gachagua from office.
Justice Bahati Mwamuye, who deemed the matter urgent, scheduled a mention for October 25. Mwamuye instructed the petitioners to serve all respondents and interested parties, including the Speaker of the National Assembly, the Speaker of the Senate, and the Attorney General, by the close of business on Wednesday, October 23. All involved parties were mandated to submit their affidavits regarding the case.
Mbugua remarked, “The petition we submitted with the Gema Watho Association contesting Gachagua’s impeachment has been recognized as urgent, with further instructions set for October 25.”
The case is attracting considerable legal scrutiny, as the government is preparing to contest the impeachment through the Office of the Attorney General and Solicitor General.
In a related development, a separate ruling is anticipated at 3 PM from a three-judge panel comprising Justices Eric Ogola, Antony Mrima, and Freda Mugambi, regarding their continued involvement in Gachagua’s impeachment proceedings.
