Impeached Deputy President Rigathi Gachagua have moved with speed to block the swearing-in in of Prof Kithure Kindiki into the office of Deputy President shortly after High Court judges vacated conservatory orders.

Shortly after High Court judges Eric Ogola, Antony Mrima and Freda Mugambi ruled that the conservatory orders that were issued by the Kerugoya Law Courts be vacated, Gachagua’s legal team did not waste any time to make fresh applications for conservatory orders to be granted by the three judges.

Speaking at the Milimani Law Courts today, Advocate Ndegwa Njiru told the court that the reason they wanted a fresh conservatory orders to be issued by the same Court that vacated the Kerugoya conservatory orders, was because Kithure Kindiki does not qualify to be the Deputy President of Kenya.

Advocate Ndegwa told the court that their is no possibility that Kindiki was cleared by the Independent Electoral and Boundaries Commission (IEBC), yet the IEBC have no Commissioner as required by the law.

Three other lawyers representing DP Gachagua also asked the court to grant them stay orders blocking the swearing-in of Kithure Kindiki, pending their move to appeal the vacation of conservatory orders at the appelant court.

Giving directions over the applications for new conservatory orders, Justice Eric Ogola informed the lawyers that they will make a ruling on the applications at 5:30 PM today. Ogola ordered the Court to take a short break for the judges to make a decision over the matter before coming back for a ruling at 5:30 PM.
