Kenya Film Classification Board (KFCB), with assistance from police from the Kapsoya Police station in Eldoret, has arrested and detained gospel artist William Getumbe.

In a statement posted on X, KFCB stated that Getumbe has been arrested over non-compliance with the Films and Stage Play Act, Cap 222 of the constitution.

His arrest comes after the lapse of the seven-day demand notice after violating Sections 4 and 12 that dictate the creation, possession, distribution, and exhibition of audio-visual content in Kenya.

“Getumbe’s arrest comes after the lapse of a seven-day ‘Demand Notice’ issued to him for violating Sections 4 and 12 of Cap 222 governing the creation, possession, distribution, and exhibition of audio-visual content in Kenya, specifically the creation, distribution, and exhibition of the blasphemous ‘Yesa Ninyandue’ music video, among others,” reads in statement.

He shall be arraigned in court on Wednesday, 13, March 2024 to face charges of filming without a license, distribution possession, and public exhibition of obscene cinematograph films and public exhibition of indecent performances contrary to Section 181 (1) (a) and (e) of the Penal Code.

KFCB has urged the public to report instances of indecent content being distributed or exhibited via social media and other broadcast channels for appropriate action.

“We also encourage members of the public to report to KFCB any instances of ‘indecent’ content distributed or exhibited via social media platforms and other broadcast channels for appropriate action to be taken. Further, the Board appeals to members of the public to desist from circulating inappropriate audio-visual content that the Board has flagged, as doing so will result in legal action.”

This action comes after KFCB threatened legal action against Embarambamba and Getumbe over the spread of inappropriate content on media platforms.

In a statement on February 29, KFCB Acting CEO Nelly Muluka identified their songs as violations of Films and Stage Plays Act Cap 222 of the Laws of Kenya.
