At the Nairobi Family Court, Justice Fred Ogolla delivered a stern warning to the family of the late former President Mwai Kibaki.
The backdrop of the tension revolves around a failure to reach an out-of-court agreement with two individuals claiming to be Kibaki’s children, namely Jacob Mwai and an unidentified woman.
The court had generously granted the Kibaki family and the claimants a two-month window to settle their differences through negotiation. However, on Tuesday, December 19, the legal representatives of the Kibaki family informed Justice Ogolla that attempts to reach a consensus with their alleged siblings had failed.
Responding to this revelation, Justice Ogolla extended the negotiation timeline but accompanied it with a stern caution. He warned the Kibaki family that, should they be unsuccessful in reaching an out of court agreement, he would proceed to hear an application seeking the exhumation of Mwai Kibaki’s body for a paternity test.
The courtroom saga unfolds with the specter of a paternity test hanging in the balance, adding an intriguing layer to the legal proceedings.
Lawyers representing Mr Jacob Mwai – one of the claimants has remained adamant in the quest to have the body of the former president exhumed and samples collected to facilitate a paternity test. He claims to be Kibaki’s eldest son.
In his will, Kibaki did not recognize any child out of wedlock. Case continues.
