Up until the conclusion of an ongoing out-of-court settlement agreement, a judge has prolonged orders prohibiting security forces from arresting former Interior Cabinet Secretary Fred Matiang’i about an alleged police raid at his residence.
The Directorate of Criminal Investigations, the Office of the Director of Public Prosecutions, and Dr. Matiang’i were each given one week to complete the truce process by Justice Kanyi Kimondo. He instructed them to submit the final contract to the court.
The agreement relates to the withdrawal of the petition Dr. Matiang’i filed in February of this year opposing any arrest or prosecution related to the purported raid by an elite police squad on his Karen residence. The court will accept the consent as the case’s final ruling.
Danstan Omari, Dr. Matiang’i’s attorney, informed the court that the DPP had written to the DCI ordering them to halt their inquiries.
He continued by saying that the DPP had also instructed the DCI office not to initiate any additional police action regarding the matter of the supposed police raid.
The attorney claimed that the DPP had instructed the DCI to end the investigations in a press release.
“We have been instructed to close the applicant’s investigative file, and the DCI has been informed of this. We are asking for a mention date so that we may have the consent presented before the court to confirm the same. A State attorney backed up Mr. Omari’s claims.
On June 7, the matter was scheduled for mention to confirm that the disagreement had been resolved amicably and that the parties had submitted consent.
After the police allegedly searched his home in Karen, Nairobi, on the night of February 8 and 9, 2023, Dr. Matiang’i filed the petition.
