Chief Justice Martha Koome’s communications advisor Michael Mumo has flagged need that a top Supreme Court judge was planning to resign as fake.
The news had been spread through one of the online news outlets which had alleged that the top Supreme Court judge wanted to resign due to dictatorship.
According to the article which was also circulated by tukonews, the judge was facing a lot of pressure from both internal and external sources.
The allegations were being spread at a time when the Supreme Court faces backlash from Kenyans and their representative (Members of Parliament) over their latest ruling on the queer community in the country.
President William Ruto and his deputy Rigathi Gachagua are the latest high-profile figures to castigate the Supreme Court on its verdict on the queer community.
Ruto said that, while he respects the court and its ruling, LGBTQ has never had and will not be incorporated in Kenya, asking those behind it to practise it elsewhere.
“Even though we respect the ruling of the court, our traditions and religion would not allow a man to marry a fellow man or a woman a fellow woman. That cannot happen in our nation. It can happen elsewhere but not in Kenya,” said the president.
On February 24, 2023, the Supreme Court ruled that denying LGBTQ members the right to register as an NGO was discriminatory. This came after a lower court decision in 2013 that barred the National Gay and Lesbian Human Rights Commission (NGLHRC) from registering in Kenya. The decision was decided 3-2 by the Supreme Court.
Farah Maalim went even further, requesting that the Supreme Court be censured for attempting to legislate from the bench. He also advocated for the death penalty for LGBTQ offenses, claiming that it was worse than murder for Africans.
