Senior Counsel Eric Theuri has sparked debate after reacting to a court order that placed strict restrictions on Morara Kebaso.
In his post on X, Theuri questioned the independence of the court, saying, “How are we supposed to believe that this is a Court independently acting?
The broad nest and extent of those interim reliefs is mind boggling.” His remarks have attracted widespread attention, with many Kenyans discussing whether the orders are too broad.
The court document shared online shows that Morara Kebaso has been temporarily barred from making or publishing statements about Borabu MP Patrick Osero on several issues until the case is heard.
The orders also prohibit him or anyone acting on his behalf from spreading comments through social media, public gatherings, interviews, podcasts, or any other platform.
The matter is scheduled for mention later in the month after the respondent is served.
Theuri’s main concern is not about the case itself but about the scope of the interim orders.
According to him, the restrictions appear unusually wide because they cover different forms of communication and even limit statements before the court fully hears the dispute.
His comments suggest that such orders could raise questions about judicial independence and freedom of expression.
The post has generated mixed reactions online. Some people agree with Theuri, arguing that the orders may be excessive and could limit public debate.
Others believe the court acted within its powers to prevent the spread of statements that could damage a person’s reputation before the case is determined.
As discussions continue, the court proceedings will likely provide more clarity on the reasons behind the orders.
Until then, the debate highlighted by Theuri’s comments is expected to remain a major talking point, especially among those following legal and political developments in Kenya.
