Embu High Court has dismissed a petition challenging the election of Leo Wa Muthende as the Member of Parliament for Mbeere North, upholding his victory in the recent elections. The court ruled in favor of Muthende, rejecting the claims presented by the two petitioners who sought to nullify the election results.
In addition to dismissing the petition, the court ordered the petitioners to pay Sh800,000 in costs to Muthende, citing the need to cover legal expenses incurred during the proceedings. The ruling reinforces Muthende’s position as the duly elected representative of Mbeere North Constituency and brings closure to the legal dispute surrounding his win.
The petitioners had argued against Muthende’s election on grounds that have not been detailed in public reports. However, the court found no merit in their claims and concluded that the election was conducted in accordance with the law. Legal experts note that such dismissals are common when courts determine that electoral processes were free, fair, and transparent, and that there was insufficient evidence to warrant overturning the results.
Muthende expressed relief following the ruling, stating that the court’s decision strengthens the democratic process and emphasizes the importance of respecting the electorate’s choice. Meanwhile, political observers have highlighted that this judgment could serve as a deterrent to frivolous election petitions in the future, encouraging candidates and supporters to adhere to legal channels while respecting electoral outcomes.
With the High Court’s decision, Leo Wa Muthende can now focus fully on his parliamentary duties, representing the interests of his constituents in Mbeere North and addressing ongoing development issues in the region. The ruling is likely to be welcomed by his supporters, who have been anticipating confirmation of his mandate.
